Terms & Conditions
HGV Training Cost Ltd want to make the experience of gaining your HGV licence the best it can be, therefore we need our candidates to be aware of the following: (a) To help us give you the best service possible, please keep HGV Training Cost Ltd updated with accurate information and up-to-date contact details at all times throughout your training. (b) You need to ensure that you have valid, official legal driving documents at all times. You will need to take your driving license and theory test pass certificates to all of your tests. If you don’t take them, you may forfeit your test or lose your training. (c) We book your theory tests/practical driving tests with the DVSA, therefore you need to be aware that they are subject to the DVSA terms and conditions. (d) You will need to ensure you have a valid licence with the correct entitlements for each course, if you do not or have been disqualified/ banned from driving you will forfeit your course. (e) We will share your Driver Information with our training locations in order to make your booking.

In response to our candidates following the above, HGV Training Cost Ltd will do the following: (a) we will support you and give you advice regardless of your HGV driving experience level. (b) We will set up your online theory test training if you are required to sit a theory test (c) We will allocate Multiple Choice/Hazard Perception/Module 2 CPC theory test appointments for you (if required) to suit your availability. (d) We will request & book training dates & test dates to suit the your availability (e) We will request & book Module 4 CPC practical training dates to suit your availability (if required to do Initial Driver CPC) (f) We will make sure you work with an experienced, friendly training coordinator to guide you through your course, and to be a helping hand when you need it. (g) On successful completion & pass of a practical test, we will provide an on-going complimentary recruitment service. This includes writing cover letters, creating/editing CV’s and providing tailor made job listings which are populated using your job specification, which you can apply for directly. (h) We will provide you with up-to-date industry news to prepare you for interview. (i) We will provide you with a recruitment information pack (if requested) which includes information on how to write a CV, how to write a cover note & interview tips & techniques. (j) We will arrange for driver digital tachograph smart card application forms to be sent to you upon request.

  1. GENERAL & LIABILITY TERMS

1.1 These terms apply to all products and services offered by HGV Training Cost Ltd, registered office, 84 Brookwood Road, Southfields, London, SW18 5BY. VAT number: 207842117, Company number: 08992424. HGV Training Cost Ltd agrees to provide products and services to you as per the terms and conditions below. By purchasing a service or product from HGV Training Cost Ltd, the customer agrees to be bound by these same terms and conditions.

1.2 At HGV Training Cost Ltd we endeavor to provide our services with reasonable skill and care. We limit our liability to you to the fullest extent permissible by applicable law, to all fees you have paid us in the 12 months prior to a claim. Nothing in these terms excludes nor limits our liability for death or personal injury caused by our negligence nor for fraud or fraudulent misrepresentation. However, we do not accept and hereby exclude liability for indirect loss, loss of profit, revenue or good will.

1.3 These terms and conditions are governed by English Law. In the event of a dispute, both parties agree to submit to the non-exclusive jurisdiction of the English Courts. Should you have any complaint, please raise it with us first, so that we may be given a chance to resolve your query.

1.4 Any variation to these terms must be agreed in writing and signed by both of us.

1.5 Calls made to HGV Training Cost Ltd can be recorded for training & monitoring purposes and we always ensure we comply with the Data Protection Act 1998. Your personal data will not be passed on or sold to third parties without your consent however our contractors and connected and associated/joint venture companies may process your personal data on our behalf. We may pass your details to companies and recruitment agents interested in hiring drivers, If you would not like us to do this please notify us and we will cease to do so within 30 days of receipt of notice.

1.6 HGV Training Cost Ltd reserves the right to update or amend these Terms and Conditions at any time, the Terms and Conditions prevailing at the time of enquiry apply. Any changes made are made in accordance with law and do not affect your statutory rights. These terms are the entire agreement between us and replace any other or earlier terms and you agree you have not relied on any representation from us in entering into this Agreement.

1.7 Security and Data Protection
We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires.

Data Protection Act
In accordance with the GDRP Data Protection Act, personal data shall be processed fairly and lawfully. Personal data shall be obtained only for specified and lawful purposes, and shall not be processed in any manner incompatible with those purposes. Personal data shall be adequate, relevant and not excessive in relation to the purposes for which it is processed. Personal data shall be accurate and, where necessary, kept up to date. Personal data shall be kept for no longer than is necessary for the purposes for which it is processed. Personal data shall be processed in accordance with the rights of data subjects under the Act. Personal data shall be subject to appropriate technical and organisational measures to protect against unauthorised or unlawful processing and accidental loss, destruction or damage. Personal data shall not be transferred to a country or territory outside the United Kingdom unless that country or territory ensures an adequate level of data protection.

HGV Training Cost Ltd will need to share certain data with the DCSA, Pearson VUE Professional Centres and other third party organisations involved in the training process. Please refer to our Privacy Policy for full and further details regarding data.

  1. PRICING

2.1 Our prices include VAT at the current rate.

2.2 We review our prices and they can change therefore at the point of purchase please make sure you check the price you have is still current. Once you have purchased your course the price becomes fixed and will not change throughout your time with us.

2.3 After purchasing our products or services you are not able to book any further products or services with the training school you initially trained on until 24 months after your courses with us are completed.

2.4 If at any point you book HGV products or services through someone other than HGV Training Cost Ltd we will be unable to offer you any of our recruitment services.

  1. ORDERING

3.1 Your contract with us starts as soon as we take payment and received the signed DocuSign for your booking.

3.2 After booking your course by phone we will email or post, via recorded delivery, your receipt and an outline of your course. If you don’t get either of these you need to tell us so we can resend.

3.3 HGV Training Cost Ltd may have to refuse your booking if: – We cannot offer the training you want, you do not meet the criteria set out in our Terms and Conditions or if the cardholder is not present at the time of booking and we cannot obtain authorization for your payment.

3.4 All payment taken by credit card will be processed with a 2% charge, this is non-refundable after the cooling-off period.

3.5 Your booking is valid for 12 months, after that date your course will expire and no refund will be due. To avoid disappoint we suggest you work with your Training Advisor to get each part of the course booked in quickly and we ask that you are flexible in your requirements as we may need to ask you to travel further afield in order to get you through before the 12 month deadline.

3.6 You will receive email confirmation of any booking you make, if you do not receive these you need to tell us so we can resend.

3.7 A full course includes one attempt at the Multiple Choice and one attempt at the Hazard Perception

3.8 We offer a recommend a friend scheme, we will give you £100 refund for every friend you recommend to us who meets the below criteria: (a) Not spoken to us before you (b) Introduced by you only (c) Books a ‘full course’. A ‘full course’ is 1 HGV Training Week + two of the following courses; Direct Access Course, Sure Pass, Initial CPC Qualification. (d) Can’t be paid for by you. (e) Not a multiple booking.

  1. DELIVERING YOUR TRAINING

4.1 The minimum course length of our Category C or C+E courses is 16 hours (this includes the time whilst on test). These hours can be split between two and six days. In the HGV training industry, training of up to 4 hours in length is referred to as ‘a day’.

4.2 Your training will be arranged on either a 1:1 or 2:1 basis. If you specifically require either 1:1 or 2:1 training you need to make sure you specify this, we’ll do our best to allocate you to a suitable course however candidates need to be aware that we can only do so if it is operationally viable.

4.3 To gain your licence you are able to complete practical training in either an automatic or manual vehicle. Both courses give you the same licence and allow you to drive both types of vehicle once passed. Your training will be booked in the vehicle type available at the time unless specifically requested at the time of booking, even in that case we cannot guarantee.

4.4 For Category C+E licences your training may be booked in a fully articulated vehicle or a Category C vehicle with a trailer dependent on availability. Both courses give you the same licence and allow you to drive both types of vehicle once passed. Your training will be booked in the vehicle type available at the time unless specifically requested at the time of booking, even in that case we cannot guarantee.

4.5 Our courses are of a uniform duration and standard. It is your responsibility to ensure that you’re driving standard is sufficient to pass the test within the timeframe allowed by the course booked. Therefore, if the Examiner/Instructor or Training School feels you are not ready for test on the final day, you may forfeit the test appointment. In the event that you cannot test, we will not be held liable for any costs including but not limited to; extra training, replacing the forfeited test or loss of earnings.

4.6 Sure Pass can only be redeemed against practical training. The Sure Pass gives you one extra attempt including at least 1 hour’s training before test, without Sure Pass retests carry additional costs.

4.7 If your instructor advises that, in the interests of road safety, you require further training, we are not responsible for the costs of such extra training. Costs will be covered by you and be paid to us only. No fees must be paid to anyone other than HGV Training Cost Ltd and if you are in doubt about whom to pay it is your responsibility to contact our head office and obtain confirmation in writing.

4.8 Any training or test time missed due to the trainees delay such as traffic or illness will need to be rebooked at the expense of the candidate. Any missed training time due to a school delay such as truck breakdown or instructor lateness will be reallocated without charge.

4.9 All telephone bookings will be confirmed in writing or via email. If you do not receive confirmation of your booking it is your responsibility to contact 0808 1781 600. If you do not contact us, we cannot be held liable for any lost training, missed tests, etc. that may arise as a result.

4.10 Under Driver CPC Legislation candidates may have to complete CPC courses. Although we will endeavour to advise you to the best of our ability as to which CPC courses, if any, you require it is the trainee’s responsibility to ensure that they are correctly qualified. Before booking a CPC course with us (either initial or periodic), we advise you to check your booking the correct course, if needed at all.

4.11 The DVSA (DVANI for Northern Ireland) will require confirmation that you have been a resident for more than 185 days through the past 12 months before allowing test. It is your responsibility to ensure that you meet these criteria and inform the examiner at time of test, if your test is cancelled or terminated due to not meeting these criteria the cost will be forfeited by you and all fees paid will be lost.

  1. RESTRICTIONS TO TRAINING

5.1 You must ensure that you are not under the influence of alcohol or illegal drugs during your course. If anyone at HGV Training Cost Ltd has reason to believe that you are under the influence of drugs or alcohol, the course will be terminated immediately and all relevant fees will be forfeited.

5.2 You are expected to exercise due care and attention when taking over-the-counter or prescription medicines in the run up to your course. If you are in doubt about whether any medication could affect your driving we advise you consult your GP.

5.3 In the interests of public safety you are advised against working during your training week as you are expected to be well rested during your course. If you choose to work during your course it is your responsibility to ensure that you are not dangerously tired when training. If an Examiner/Instructor or Training School feels that it is not safe for you to continue to train or test due to signs of exhaustion or tiredness HGV Training Cost Ltd reserves the right to terminate your training until you are deemed fit and safe to drive. Any training missed during this time will be forfeited and will not be reimbursed.  Alternatively you may be sent home for the rest of the session.

5.4 If after purchasing a course with us you are banned from driving for any reason, your rights to any refund will be as per the Terms laid out in Clause 6.

5.5 You must commit to conduct yourself in an appropriate manner: HGV Training Cost Ltd reserves the right to terminate a course without notice should they decide that any candidate has acted or behaved inappropriately, including but not limited to verbal and physical abuse towards HGV Training Cost Ltd staff, Training Partner staff or DVSA staff. If a candidate wishes to appeal such a decision they should do so to the Customer Services Team by following the Cancellations and Complaints procedure listed under Clause 6.

5.6 It may sometimes become necessary to allocate more than one Instructor to a course. We reserve the right to arrange training in this way without first notifying you, if there are legitimate reasons for the arrangement.

5.7 Training can start at various times of the day and last anything up to 8 hours. You must make sure you are available for training at any time during the dates as required, any time missed will be forfeited.

5.8 HGV Training Cost Ltd commit to providing you a high standard of training and a great standard of service. Therefore, because pass rates fluctuate, we reserve the right to change the training location we initially discussed with you at the point of purchase if there are legitimate operational or service reasons for the change.

5.9 We cannot guarantee timeframes for course completion as we work with a live system covering the whole of the UK. Availability can fluctuate, so any dates discussed with you at the point of purchase are subject to change.

5.10 In the event of training being cancelled due to any unforeseen circumstances, for example bad weather, HGV Training Cost Ltd are not liable for any costs incurred by you including but not limited to; loss of pay, transport costs and the like. You are responsible for taking out a relevant insurance policy which will protect you in the unlikely event that they are unable to attend training or tests booked for them for any reason.

5.11 Due to the nature of our business HGV Training Cost Ltd have to comply with the prevailing licensing legislation at the time a booking is made. If there are changes to this legislation which affects our candidates booking during their time with us, we will make every reasonable effort to inform them of the meaning of the change and how it affects them. If changes to legislation mean that customers need to purchase additional courses in order to remain complaint HGV Training Cost Ltd are not responsible for any costs.

5.12 We accept payment by debit or credit card. We do not accept payment by cash, or by American Express.

  1. CANCELLATION & COMPLAINTS POLICY

6.1 Full details of the complaints and refunds procedure can be requested at any point by emailing info@hgvtrainingcost.com.

6.2 If you become unhappy with any product or service provided you have the right to complain. Any complaints should be received within 7 days of the incident occurring and must be directed to HGV Training Cost Ltd Customer Services, sent in writing by Recorded Delivery, via email or telephone.

6.3 Should a candidate wish to cancel their training course completely they must notify us in writing via recorded delivery to HGV Training Cost Ltd, Customer Services, Office 20, 143 Kingston Road, London, SW19 1LJ, via email to info@hgvtrainingcost.com or via telephone on 0808 1781 600.

6.4 HGV Training Cost Ltd will acknowledge receipt of any complaint or refund request in writing within 5 working days of receipt and reply in writing within 28 working days.

6.5 You have a right to cancel within 14 days of booking a course as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, however if any of the services have started then this can be excluded by us.

6.7 Course fees paid to us are assigned to that specific course and therefore are non-transferable.

6.8 In the event that you receive a permanent fail on your medical, a full refund of all course elements not started will be given upon receipt of proof of failure. Please be aware proof of failure will only be accepted from DVLA, no others sources. As per clause 6.6 we cannot refund course elements which have been activated, started or completed.

6.9 If you request a refund or make a complaint in writing we reserve the right to cancel any active training courses/bookings on your account.

6.10 All refunds offered are available for 4 weeks, failure to accept the refund within this time will mean the offer becomes void and you will need to reapply for a refund. This could result in extended cancellation charges. Refunds will be processed within 14 days from the date of acceptance.

6.11 If you decided to cancel or reschedule a booked training week rather than an entire course you must provide a minimum of 4 weeks’ notice before the first day of the course, otherwise the full fee is charged. It may be possible to substitute people or defer the course to another date at the discretion of HGV Training Cost Ltd.

6.12 If you submit a chargeback via your bank we will immediately suspend any training and cease any refund request communication which is currently in process. We will then only deal with this request via the acquirer until the chargeback/ retrieval request has been resolved. If the retrieval is unsuccessful and we receive notification to this affect from the acquirer we will re-commence training. If the retrieval is successful and a chargeback is raised, any training booked with us relating to this item will be cancelled immediately without prior notice. You need to check the status of a chargeback/ retrieval with their card issuer, we will be unable to assist with this via telephone.

7.1 The material on this website is our copyright and you must not copy it without our permission nor use it for any business purpose. Although we try to ensure it is up to date we cannot be liable for any inaccuracies. We have a separate privacy policy on the site setting out how your personal data will be used. Nothing in these terms affects your rights.

8.1 Nothing in these terms is intended to affect your statutory rights regarding the quality of our services or any products that we supply to you. Should you require more information regarding these rights, please contact either the Citizen’s Advice Consumer Service, or your Local Authority Trading Standards Service for further advice.
